Pregnant woman seeks to abort pregnancy due to marital distress

  • A 20-year-old pregnant woman has filed a petition in the Supreme Court to grant her permission to terminate her pregnancy.
  • The lady, who is 22 weeks pregnant, wants to abort her child as she has been a victim of domestic violence.
  • Her husband threw her out of the house, when she crossed the 20th week of pregnancy.

While speaking to My Medical Mantra, Dr Nikhil Datar, a well-known gynaecologist and a Director of Cloud Nine hospital said, “I am happy that the Supreme Court has admitted the petition filed by this 20-year-old girl to terminate her pregnancy. She is just a young girl, who is beyond her 22nd week of pregnancy. Her husband and the in-laws have thrown her out of the house. So, she wants to terminate her pregnancy.”

Dr Datar further added, “Let us see what the court feels about mental anguish she has been inflicted with due to these events. Is it a sufficient reason for termination of pregnancy? Earlier, the Bombay High Court had rejected her petition.”

In India, the law does not permit a woman to terminate her pregnancy post 20 weeks. But, there are exceptions in cases where the foetus had abnormalities and is unlikely to survive; the court has granted permission for termination in such cases.

But, this case is a special one, as the young 20-year-old woman is seeking termination on the basis of the mental agony and trauma she has gone through, as her husband and in-laws have thrown her out of the house.
